When a violation of the law is detected, the FAS carries out raids against violators with the confiscation of counterfeit products and the imposition of a fine.
The use of someone else's or a similar trademark leads to the fact that consumers can confuse products in the market. Therefore, the copyright holder has the right to apply to the Rospotrebnadzor as a body protecting consumer rights and ask to verify the legality of the actions of the violator. Based on the results of the inspection, the Rospotrebnadzor draws up an administrative protocol and submits the case materials to the court.
The application of the criminal law method of protecting rights, which implies contacting the police , takes place if the illegal use of the trademark has been committed repeatedly or caused a major damage (in the amount of more than 250,000 rubles). As a rule, this method is used when a conflict arises between large companies.
